General Submission Rules
Our Submission Rules are simple and straight forward. Follow the 2 main guidelines below and you are free to upload as MUCH as you want, as OFTEN as you want. For information on our POPULARITY POINT COMPETITIONS, please see below.
o ABSOLUTELY no pornographic or explicitly violent material. All material that you, the user, consider to be inappropriate for a general audience (anything that would exceed a pg-13 rating, for example) should be uploaded into our UNCENSORED video library. However, no area of the Viddiction library will accept, or retain any material featuring full frontal nudity or graphic violence. This is not Faces of Death, so please do not treat it as such.
o We are very weary of Copyright laws and ask that you do not post material to which you do not own the rights, or permission from the party that does own the rights. We like original material; material that is the product of YOUR imagination. To be safe, post only those clips that you can claim as your own. THIS IS ESPECIALLY IMPORTANT IN OUR MONTHLY POPULARITY POINT COMPETITIONS. POPULARITY POINTS DERIVED FROM MATERIAL SUBMITTED THAT IS SUSPECTED TO BE COPIED OR STOLEN FROM SOURCES OTHER THAN THE USER WILL NOT BE COUNTED TOWARDS YOUR MONTHLY POPULARITY POINT TOTAL!!
Guidelines and Rules for Popularity Point Competition
1.) The following Rules represent the Agreement between Member (defined below) and Viddiction.com Brainstem Cybermedia LLC in its entirety.
GUIDELINES
2.) All entrants must have a valid e-mail address and must be, or become at the time of entry, a registered member of the Viddiction.com website. False or deceptive entries or acts, including false or incomplete information submitted during the entry or registration process, may, upon discovery by Sponsor, render the entrant ineligible to participate in the Contest.
3.) To become a Member, you must register a username and password with our website. All that will be asked of you is a valid email, a first name, and the state or nation in which you reside. all information will be kept private, never be sold, and will only be used for reference in our cash-prize Referal and Popularity Point Competition.
4.) To collect winnings, members must be 18 years or older. Members under 18 years must have parent/guardian's permission to participate in competitions.
ENTRY
5.) All video submissions (“Submissions”) must be submitted in a digitally-supported (.avi, .mov, .gif…etc) in format.
6.) Prior to uploading a video, Member must indicate if the video is eligible for entry into a Viddiction contest.
a. A video entry is eligible for a contest if:
b. the Member indicates that the video is eligible, the Member must agree to accept the conditions of the Popularity Point Competition by checking a box at the end of the guidelines. Videos entered under these standards are ”Inclusive Videos”.
c. the Member indicates that the video is not eligible, the Member may nonetheless post the video, but agrees that the video is not eligible for Popularity Point accumulation and Member hereby waives its rights to accrue Popularity Points. All videos submitted without positively indicating eligibility to the Popularity Point Competitions will be indefinitely stored in the Viddiction General Video Library—a comprehensive database containing all videos from past competitions, as well as videos that never met the standards for competition, but were uploaded for general viewing purposes.
d. It is properly uploaded, is named using any alpha-numeric label conisting of at least 1 character, and will readily function upon activation through video viewer or other link .
e. Only videos conforming to Viddictions standards and practices [this may be part of the guidelines or terms of use, but there needs to be guidelines as to acceptability, including limits on vulgarity, pornography, etc.] as Viddiction determines in its sole discretion, will be eligible for consideration.
f. Member must sign a release and indemnity in the form provided by Viddiction, representing, among other things, they are the rightful owners of the Submissions, and that the video may be submitted and broadcast, without obtaining permission from or making any payment to any third party. All persons appearing in the video(s) must sign consent forms and/or releases (which shall, among other things, grant to Sponsor the right to use such person's name, voice and likeness in any manner including, without limitation, for programming, promotional and advertising purposes) before the submission can be eligible for prize awards. A custodial parent or legal guardian must sign the consent/release form for minors. Failure to provide requested releases and/or consents will result in disqualification of the Submission Notwithstanding the foregoing, and without limitation of the rights granted to Sponsor, the submission of a video constitutes the submitter's permission to use the video and the name, voice and likeness of the submitter, as well as the submitter's representation that he/she has obtained all necessary permissions and approvals to use the video and the name, voice and likeness of all persons appearing in the video, in and in connection with the program and all exploitations thereof or otherwise, including, without limitation, for programming, advertising and promotion purposes, in all media now known or hereinafter created.
g. Each submission must be solely the original work of entrant
h. Winners of any prize are solely responsible for all federal, state and local taxes
7.) Member may upload as many as, but no more than 50 Inclusive videos a month.
a. Member will be made aware of how many videos they have remaining in their monthly allocation each time they upload a new Inclusive Video.
8.) Member may post an unlimited amount of Exempted Videos.
9.) ALL videos submitted must be no less than 10 seconds, and no greater than 20 minutes in duration.
10.) ALL videos must strictly adhere to all the general submission policies described in the Viddiction Terms of Use.
11.) By making a Submission, Member grants the Sponsor, including all assigns and successors, an irrevocable perpetual license to reproduce, distribute, publicly perform, publicly display, create derivative works of, and perform by means of audio transmission the Submission.
12.) In the event of violation of community standards and/or codes or conduct, Viddiction reserves the right to deactivate and delete any Submission from any and all of its Member areas and databases.
13.) Member represents and agrees that Submissions do not infringe on any third party’s copyrighted material, trademark or other intellectual property rights, or privacy or publicity rights
14.) By adding content to the General Video Library MEMBER AGREES TO ASSUME ANY LIABILITY FOR COPYRIGHT INFRINGEMENT OR ANY OTHER CIVIL ACTION BROUGHT FOR UNAUTHORIZED USE OF THE SUBMISSION, AND AGREES TO RELEASE, DISCHARGE, DEFEND AND HOLD HARMLESS VIDDICTION.
15.) By adding content to the Video Library, MEMBER AGREES THAT VIDDICTION, ITS ASSOCIATES AND AFFILLITATES ARE NOT LIABLE FOR ANY DEROGATORY OR DEFAMATORY STATEMENTS MADE WITH RESPECT TO ANY SUBMISSION
16.) In the event that the winning Member is found to have posted the Duplicate Videos(defined as a video that already exists anywhere in the Viddiction database) as part of their monthly Inclusive Video collection, both copies of the video, and all Popularity Points earned by those videos, will be removed from that month’s point total.
a. Same rules apply to Inclusive Videos duplicated from Viddiction’s Video Library
b. Any Member who is found to repeatedly post video duplicates will be banned from the Viddiction community permanently.
c. In the event a winning Member has posted a Duplicate Video
e. In the event that a winning member has entered a unique video into 2 or more unique contests on the same month--only one instance of that video may count towards the member's popularity point total. Two instances of a video in any single month will lead to the deletion of one, and the resignation of the popularity points it has earned. The video to remain will be the one entered into the contest where the popularity point total is the smallest.
f. Similarly, duplicate or multiple user accounts, registered to a single user, will only be credited with a single win for any individual competition. In situations where multiple user accounts are winners of any single competition, the winnings awarded will be limited to the lesser of the prizes won.
JUDGING CRITERIA
17.) A Popularity Point is defined as a single view of a video that has been submitted to an active Competition on Viddiction.Com Website
18.) Winners will be determined solely by the final Popularity Point total at the end of each month.
19.) A list of past winners is available upon request.
20.) A Member earns a Popularity Point each time a video that Member has posted in the ‘Inclusive Video Library’ is viewed online, through the Viddiction Website
i. Member can increase the virulence of their creations by making compelling, well-produced videos, or by catching unique, spontaneous moments.
ii. Member can further substantially increase his or her popularity points by promoting their video, either by the use of tools made available by the Viddiction website itself (such as email promo tool, and in Viddiction forums), or by any legal outside means.
21.) Inclusive Videos can only accumulate Popularity Points for that user’s Popularity Point total for a maximum of one full contest period.
22.) After a contest period expires, all Inclusive Videos uploaded for that contest period lose their inclusive status and are downgraded to Exempted status and stored in Viddiction’s General Archives (explained below), indefinitely.
In the event of fraud or unforeseen glitches (server shutdown, power failures, programming error resulting in temporary shutdown of website) to the announcement of the current month’s winners, all high-ranking videos will be reviewed, and Viddiction reserves the right to exclude any video suspected of copyright infringement.
23.) For each Competition Period, 5 tiers consisting of no more than 155 winners will be awarded with prizes.
a. Winnings are limited to 1 prize per household
b. The Competition Period is defined as a calendar month, beginning the first day of each calendar month at 12:00 am, closing the last day of the month at 11:59 pm.
c. Winners will receive an notification by email within 5 days from the close of the contest if they have won.
24.) Odds of winning depend on the number of entries received
i. At the close of a Competition Period (defined as the calendar month in which a competition runs) all Popularity Points are set to zero, and the next Competition Period begins.
ii. Videos submitted as Inclusive Videos accumulate Popularity Points from the moment of submission, until the termination of the Competition Period.
a. Prize tier size and reward value based on 36 entries are to be as follows:
2. i. Level 1 (1 winners) $500
3. ii. Level 2 (5 winners) $300
4. iii. Level 3 (10 winners) $100
5. iv. Level 4 (20 winners) $50
b. Since all Popularity Points from all videos submitted by a single members are to be totaled together at the close of the Competition Period, A single Member may win no more than a single prize during any Competition Period.
c. All unclaimed or unawarded (in the event that fewer than 155 members participate in a given Competition Period) prizes shall be retained by Viddiction to be recycled into the following Competition Period.
d. Tier sizes and reward value are subject to change at any time
e. In the event of a three-way tie [[how is this resolved?]]
i. Member will be informed of tier modifications prior to the commencement of the first Competition Period affected by the change
25.) The Popularity Point Competition is a contest, and is considered VOID WHERE PROHIBITED, according to the laws of the Member’s jurisdiction of residence.
26.) Member assumes the responsibility of being aware of all local laws concerning the publication of video content for transmission to a global audience, as well as the laws regarding collecting prize money for successfully promoting this video content.
27.) By accepting these conditions, Member also accepts that all disputes shall be finally settled by arbitration in the State of Maryland. All laws governing such arbitration will be consistent with the laws of that state.
28.) ALL VIDDICTION COMPETITIONS ARE VOID TO NON-US RESIDENTS. PAYOUTS WILL NOT BE MADE TO ANY MEMBER OUTSIDE OF THE AUTHORIZED AREAS [[further define authorized areas]]
Paid Competitions
ENTRY
1.) Viddiction will periodically run competitions requiring an Entry Fee. Such contests will be referred to as Paid Entry Competitions.
2.) A Paid Entry Competition will be for a calendar month, starting on the first day of a given month at 12:00 a.m., and terminating on the last day of the month at 11:59 p.m.—The Winner of the Paid Entry Competition will be the Member who has the most Popularity Points for such Member’s submissions in the Paid Entry Competition. Popularity Points will be added together for each such submission, up to a maximum of 5 videos.
3.) Videos entered into Paid Entry Competitions can be current or past Inclusive Videos
JUDGING CRITERIA
4.) Each Member will be limited to a maximum of 5 video submissions in any one Paid Entry Competition
5.) Popularity Points earned by the pool of up to 5 videos selected by Member for participation in a Paid Entry Competition will be tallied independently of any other videos that Member may currently have active in the Inclusive Video Library
6.) Videos, and the Popularity Points they earn, can simultaneously be used to compete both in Paid Entry Competitions, as well as standard, monthly Popularity Point Competitions
7.) A winner of a Paid Entry Competition does not waive the opportunity to participate, and win in the same month’s free-to-enter Popularity Point Competition
PRIZES
8.) A single prize, starting at $3000 for a single winner, will be offered for a Paid entry Competition, but will grow as entry fees are collected from every participating Member.
9.) Entry fee revenue will be split 50/50 as follows:
a. One half to be devoted to corporate expenses
b. One half to be added to the Prize pool of the Bonus Prize Tier
c. Entry fees will NOT be added to the standard free-to-enter prize tiers
10.) All relevant rules of Inclusive Video submissions apply to Member participating in Paid Entry Competitions.
11.) Entry fee of $2 will be due on registration for a Paid Entry Competition
12.) Entry fee may be changed, by Viddiction, with notice to Member provided prior to the commencement of the first Paid Entry Competition affected by the change.
13.) Paid Entry Competition are void to all NON-US RESIDENTS, and residents of the states of Florida and New York
14.) WINNINGS WILL NOT BE PAID TO RESIDENTS OF UNAUTOHRIZED GEOGRAPHIC AREAS
15.) Winnings not claimed within 30 days of notification will be null and void.
Referral Program Guidelines and Explanation of Rewards
1. Viddiction may make available a Member Referral Competition, available to all registered Members and free to enter
2. Member Referral Competition winners will be chosen according to Referral Points earned during the Competition Period
a. The Competition Period is defined as the first day of each calendar month at 12:00 am, closing the last day of the month at 11:59 pm.
3. 1 Member Referral Point will be awarded each time an existing Member’s referral becomes an Active Member
a. An Active Member is a Member who registers with Viddiction and posts a video on Viddiction.
b. Only one Referral Point can be awarded for any one referral that leads to an Active Membership
4. At the end of the Member Referral Competition Period, Referral Points are tallied and winners are chosen by the Member having the highest number of Referrals.
5. Prizes are paid out to no more than 204 winners, divided into 5 tiers of prize value
a. Prize tier size and reward value are to be as follows:
1.) i. Level 1 (1 winner) $500
2.) ii. Level 2 (5 winners) $300
3.) iii. Level 3 (10 winners) $100
4.) iv. Level 4 (20 winners) $50
b. Member may win no more than a single prize during any Competition Period.
c. All unclaimed prizes shall be retained by Viddiction to be recycled in the following Competition Period.
Tier sizes and reward value are subject to change at any time
d. Member will be informed of tier modifications prior to the commencement of the first Competition Period affected by the changeMembers suspected of fraud or falsification of Member registration information will be banned from the Viddiction community permanently
i. By accepting these conditions, Member also accepts that all disputes shall be finally settled by arbitration. All arbitration proceedings will take place win the State of Maryland, and will be consistent with the laws of that state.
j. The Referral Point Competition will be treated as a contest, and is to be considered VOID WHERE PROHIBITED, according to the laws of the Member’s jurisdiction of residence
k. Member assumes the responsibility of being aware of all local laws concerning the publication of video content for transmission to the global audience
l. ALL VIDDICTION COMPETITIONS ARE VOID TO NON-US RESIDENTS, AS WELL AS RESIDENTS OF THE STATES OF FLORIDA AND NEW YORK. PAYOUTS WILL NOT BE MADE TO ANY MEMBER OUTSIDE OF THE AUTHORIZED AREAS
m. All official communications between contest winners, website users and Members and Brainstem Cybermedia will occur either through electronic, or first class mail.
n. All Viddiction.com online competitions are closed to employees of Brainstem Cybermedia and their families.
o. Any rules and conditions are subject to change at any time, with or without notice
